Dilemma2Een uitgangspunt in de rechtsstaat is de vrije toegang van iedereen tot de rechtspraak. Dit kan leiden tot overbelasting van de rechter, oplopende kosten en een lange duur van de processen.
De overheid heeft maatregelen genomen ter voorkoming van deze nadelige effecten. Zij verhoogde de inkomensgrens om in aanmerking te komen voor gefinancierde rechtshulp.
De griffierechten gingen omhoog. Deze maatregelen beperken de toegang tot de rechter.

Het dilemma dringt zich op: ‘snel recht’ met selectie en voorrang aan de poort of ‘langzaam recht’ met toegang tot de rechter voor iedereen op volgorde van binnenkomst?
